Divorces - No one goes into a marriage thinking that the marriage may end in divorce. If a couple is heading toward a possible divorce they are encouraged to first seek marriage counseling. Couples who have not tried counseling will never know whether they could have saved their marriage. However, if you have worked hard to make it work there comes a point in time when you have to make a decision between staying in the marriage, or moving away to find peace. Coming to a final decision in a divorce is hard enough for most people. The divorce process is typically comprised of many pieces, including child custody, visitation rights, child support payment and property division. To file for a divorce, you must have lived in the county where you file for divorce for at least 90 days and in the State of Texas for at least six months. If you wish to change your last name, it can be done for no additional cost if it is requested with your petition. If property was accumulated and/or children born during the marriage, they must be included in the Divorce litigation. All assets accumulated during a marriage relationship will be divided by the court in an equitable manner. If children were born during the marriage relationship, the court will make decisions regarding the children, based on the children's best interests. A Divorce petition must be on file for at least 60 days, with the Court, before a Divorce can be granted.
Child Support - Establish and enforce child support orders.
Custody and possession of children - The court makes custody decisions based on the best
interests of the child(ren), not what is best for the parents. A parent who is not awarded primary
possession of the child(ren) will usually be granted Standard Possession, which includes; first, third, and
fifth weekends of the month, one afternoon during each week, summer and holiday schedules.
Modification - Increase or decrease child support and custody or possession orders.
Protective Orders - If family violence has been threatened or committed, a protective order may be
obtained.
