Traffic Tickets
A moving violation or a “no insurance” violation on your record has serious consequences, such as State surcharges, the possibility of losing your driving privileges and higher insurance costs.
If you receive a traffic citation it is important that you obtain deferred adjudication, so that the citation will not go on your driving record. Texas has a system which assigns points for moving violations. A driver who does not obtain deferred adjudication and accepts a conviction will receive two points on their record, three points if the moving violation conviction resulted in a vehicle crash.
DPS will assess a surcharge when the driver accumulates a total of six points or more on their record during a three-year period. Points accrued remain on the driver record for a period of three years from conviction date. DPS will assess a surcharge when the driver accumulates a total of six points or more on their record during a three-year period. The driver is required to pay a $100 surcharge for the first six points and $25 for each additional point.
Drivers who receive a conviction for not having insurance, or driving while license invalid are required to pay a $250.00 annual surcharge for three years. Drivers without a valid license are required to pay $100.00 annual surcharge. In most cases, if you present your current proof of insurance and driver’s license we can avoid having your violation go on your record by obtaining a deferred adjudication offer.
If you are under the age of twenty-five years and do not wish the citation to go on your record and you are offered deferred adjudication, you must take and complete a defensive driving course and present a certificate of completion to the court by a certain date.
If you have a commercial driver’s license you are not eligible for deferred adjudication on a moving violation.
